Harvey Weinstein's return to Rikers island after conviction rejection sparks legal maneuvering

ALBAWABA - On Saturday, Harvey Weinstein returned to Rikers Island to have his "medical needs tended to" after a New York appeals court's rejection of his 2020 rape conviction the previous day. 

The NYC Department of Corrections and NYC H+H/Correctional Health Services are attending to Harvey's medical requirements, according to a statement from Craig Rotfeld, Weinstein's prison consultant and an authorized representative of DOCS. Rothfeld provided this information to Fox News Digital. "We are grateful for how smoothly they handled his eventual return to Bellevue's prison ward."

The star's spokeswoman, Juda Engel Mayer, confirmed to Fox News Digital that Saturday morning saw Weinstein's return to Rikers Island. 

"At the same time, we‘re cautiously optimistic and are prepared to go to trial if it comes to that," said Engelmayer. He will no longer benefit from an unfair prosecution due to the reduction of the charges. Every citizen has the same protections under our legal system, but a defendant also has the right to due process. Thankfully, the judges in the Appeals Court shared this view.

On Thursday, the appeals court ruled 4-3 that the trial judge in the Weinstein case had allowed the prosecution to call witnesses who claimed the entertainment mogul had attacked them, regardless of whether or not these claims directly related to the allegations against Weinstein.

The Hollywood Reporter predicts Weinstein's court return on May 1.

A receiving Fox News Digital's request for comment, a counsel representing Weinstein did not immediately react. 

In February 2020, the former Hollywood film producer, found guilty of forcing oral sex on TV and film production assistant Mimi Haley in 2006 and third-degree rape of hairstylist Jessica Mann in 2013, received a sentence of 23 years in prison. Over eighty women accused him of sexual assault and rape.
