ChatGPT is being sued over AI “hallucinations,” and OpenAI cannot do anything about it

ALBAWABA - Noyb, the privacy organization established by the renowned Austrian activist and lawyer Max Schrems, stated that it has submitted a complaint with the Austrian Data Protection Authority against OpenAI claiming ChatGPT breaks various EU’s General Data Protection Regulation.

AI hallucinations, according to Google Cloud are inaccurate or misleading outcomes produced by AI models as a consequence from lack of training data, wrong model assumptions, or data biases.

In its complaint, Noyb argues that hallucinations caused by ChatGPT break the “right to access” in Article 15, which states that companies must be able to disclose which data they possess on people and from what sources, something OpenAI refuses to disclose.

“While [OpenAI] has extensive training data, there is currently no way to guarantee that ChatGPT is actually showing users factually correct information,” the statement by Noyb reads, noting that ChatGPT’s hallucinations’ go against GDPR’s Article 5, in which the EU law requires personal information to be correct.

Maartje de Graaf, data protection lawyer at Noyb stated that “making up false information is quite problematic in itself. But when it comes to false information about individuals, there can be serious consequences,” adding that “It’s clear that companies are currently unable to make chatbots like ChatGPT comply with EU law, when processing data about individuals.”

OpenAI has previously addressed the issue of AI hallucinations, claiming that they are working on a new training system that should help ChatGPT provide better and more accurate results by simulating a human’s train of thought in reaching a conclusion, but these systems are yet to provide conclusive evidence.
